The much-awaited rules for the Digital Personal Data Protection Act (DPDPA) are expected to be out within a month, said Union Minister of Electronics and IT Ashwini Vaishnaw on Monday. On the contentious draft broadcasting bill, Vaishnaw said that the government will take a fresh approach with much wider and open consultation on the regulation in the content space.


He further said that once the rules are released, a public consultation period of 45-60 days will follow, which can be extended further as required.


“One of the major innovations that we did in the DPDP Act was that it should be digital by design, and it should be born digital. The entire implementation structure has to be digital, right from the beginning, and that entire digital framework has now been completed,” said Vaishnaw in a press briefing on Monday.


The said digital framework under the Act will facilitate users in processes such as how they will interact with the platform, file complaints and appeals, among others, said the Minister.


In June this year, Vaishnaw had talked about the “digital by design” platform for the first time.


Vaishnaw informed reporters that the final draft of the DPDP Act was reviewed last week and that the creation of an entire digital framework for the Act was completed.


The platform, developed jointly by the Digital India Corporation (DIC) and the National Informatics Centre (NIC) for facilitating the implementation of the DPDP Act, is beyond the beta testing phase, informed Vaishnaw.


The issue of verification for the age of children under 18 has been solved, said a senior government source.


“We have solved the issue of age verification under the requirements of the Act, and the mechanism is a very good approach that we’ve come up with,” said the official on condition of anonymity.


The DPDP Act mandates platforms to obtain “verifiable consent” from a parent or legal guardian before processing personal data of users under the age of 18. This provision was one of the most contentious issues during the public consultations on the bill last year.


Section 9 of the DPDP Act says that before handling any personal data of a child or a person with a disability who has a legal guardian, the “data fiduciary” must first get clear and confirmed consent from the child’s parent or the person’s legal guardian.
